Some of my probate work comes from the Public Administrator, responsible for administering the estates of decedents when there is no executor or when there is no other person qualified or willing to serve as administrator. (The offices of the Coroner and the Public Administrator, operating jointly as the Coroner’s Bureau, came under the authority of the Sheriff in 1989. Sheriff Gregory J. Ahern is the Coroner and Public Administrator serving the entire county.)
If the probate sale is independent administrator, then it becomes a regular sale.
Some probate sales started out with court confirmation and finished without.
If it's with court confirmation, it's more complicated because it involves more people...and a judge. Ten percent (10%) of the purchase price is usually required in a cashier's check. In some cases if there are no offers, the court may make an exception to this rule.
There are no contingencies. Buyer may do inspections, have it property appraised, or have it financed...but the purchase is not contingent on any of those things. No contingencies can be difficult for buyers.
Once the offer is accepted, buyer is committed to buying. They petition the court for a hearing date. (Backing out threatens the loss of the deposit or part of it. Furthermore, the deposit may be withheld for months.)
For the most part, the CAR Purchase Probate Agreement is used.
